If you live in Texas and need to authorize a family member or agent in India to handle property, banking, or registration matters on your behalf, you'll need a properly executed Power of Attorney (POA) that is recognized when it arrives. This guide walks through the path most NTX Apostille clients follow.
1. Have the POA drafted by an attorney
We do not draft documents. A Texas attorney (or a qualified drafter in India working with your family there) should prepare the POA, listing the specific powers you are granting and any limits. Bring the document unsigned. Texas requires signatures to be made in the notary's presence.
2. Sign in front of a Texas notary
We meet you at home, your office, or a quiet workspace. Each signer brings a valid government-issued photo ID. If the POA requires witnesses, have them present too. We notarize and add the notarial certificate.
3. Apostille at the Texas Secretary of State
Because India is a member of the Hague Apostille Convention, the Texas SOS apostille is the final authentication step. Standard processing is roughly 7 to 10 business days. Rush options exist, subject to capacity. We prepare the submission, track the apostille, and return the finished document to you.
4. Forward to your in-country agent
Once the apostille is attached, the POA is ready to be used in India. Your in-country agent typically takes it to the sub-registrar for registration (especially for property transactions). Registration requirements vary by state and transaction type; confirm with a local attorney or your agent.
